Several weeks ago, I was invited to Mpls association of realtors, because one broker (I will not mention his name) filed a complaint against me because my company has purchased a property that the other broker has listed for 1 day and switched it to TNAS (temporary not available for showings) the same day.
The seller has contacted my company back in February 2017 and has received an offer from us to purchase his house. Than the seller has contacted us again in May and said that he wanted to proceed with the offer. However in April he was approached by another broker who has listed his property for sale for 1 day only and switched it to TNAS the same day.
The seller showed me a letter that he has sent to the broker through the certified mail that he has requested to cancel the listing and I verified that that letter has been received by the listing broker, but broker/agent has never responded to the seller, and just switched the listing from Active Status to TNAS the same day when he has listed the property.
Being a licensed broker I can’t work with people that have representation, that’s why I have contacted the listing broker over the phone to discuss the situation asking him why the broker didn’t obey his client’s request to cancel the listing because one of the code of ethics of the Realtor’s is obedience. However the broker has not responded to me and I proceeded with the purchasing of the property from the seller assuming that seller’s certified letter to the listing broker was a good enough evidence that the seller had no longer had representation.
I was given a fine from MPLS Association of realtors for $7500 and in order to stay in the association I also had to take many hours of ethics classes. I decided not to waste my time on fighting with the association, cancelled my membership and joined another association, because in order to list properties on MLS one has to be a member of any of the 6 association of realtors in MN.
I also signed a paper that I would not provide the details of the case to the general public, but I just want everybody to learn my lesson that if a real estate broker doesn’t respond to you after you call, send him/her an email. Because in my case I only left voice messages to the broker and didn’t have a written email that could back me up.
